The following terms and conditions (Terms) govern your enrollment and participation in a dental membership plan (Dental Membership Plan) being offered by Dr. Zak Dental Care (Dentist). These terms and your enrollment in a Dental Membership Plan constitute a binding agreement between you and Dr. Zak Dental Care (the Agreement). If you do not agree to these Terms, do not enroll in this Dental Membership Plan. THE DENTAL MEMBERSHIP PLAN IS NOT AN INSURANCE PLAN AND IS NOT INTENDED TO REPLACE DENTAL INSURANCE. THE DENTAL MEMBERSHIP PLAN IS NOT A QUALIFIED HEALTH PLAN UNDER THE AFFORDABLE CARE ACT OR A MEDICARE PRESCRIPTION DRUG PLAN. THE MEMBERSHIP FEE IS NOT AN INSURANCE PREMIUM. NEITHER THE DENTAL MEMBERSHIP PLAN, OR THE DENTIST OFFERING THE DENTAL MEMBERSHIP PLAN, ARE LICENSED INSURERS, HEALTH MAINTENANCE ORGANIZATIONS, OR OTHER UNDERWRITERS OF HEALTH CARE SERVICES.

  • You may not combine a Dental Membership Plan with any other discounts, discount plans, dental insurance (including Medicare, Medicaid, other forms of government insurance or assistance, and/or any private insurance plan or policy), or in-office promotion
  • It is possible that, during the course of treatment by a Dentist, he or she may discover a dental or health condition, such as periodontal disease, that may require further treatment the costs associated with any further treatment are your responsibility
  • 2. ACCOUNT SIGN-UP. To enroll in a Dental Membership Plan using the zakdental.com online platform, you must open an account (the Account). You represent that all information you provide during the Account sign-up process and at any time thereafter, for yourself and for all family members (collectively, the Account Information), will be true, accurate, complete, and current, and that you will promptly update your Account Information as necessary such that it is, at all times, true, accurate, complete, and current. The Plapfrom will use and maintain your Account Information subject to and consistent with the terms set forth in our Privacy Policy. The Agreement incorporates the terms and conditions set forth in our Privacy Policy. By accessing the zakdental.com online platform and/or participating in the Dental Membership Plan, you are consenting to have your personal data and the personal data of your family members used by us as set forth in the Privacy Policy. You may enroll your spouse under your Account. You also may enroll dependent minors in the Dental Membership Plan, provided that you are the legal parent or guardian for each individual enrolled under your Account. To create an Account, you must be 18 years or older, have a unique email address, and have a payment method registered with the zakdental.com online platform. You will be required to provide your name and email address and to create a password. To access the Account, the email address and password will be required. As the Account holder, you should not reveal the Account Information to anyone else. You are responsible for maintaining the confidentiality and security of your Account Information and for all activities that occur on or through the Account.

    3. PAYMENT TERMS AND PROCESSING. The Dentist offering the Dental Membership Plan that you choose will specify available payment plans, such as paying month-to-month or paying annually. In each case, Membership Fees will be due in advance, and your payment method on file will be billed accordingly. The zakdental.com online platform uses a third-party payment processor to collect and process all payments. In order to make payments you may be required to agree to the third-party terms and conditions and/or privacy policy. You are responsible for the timely payment of all fees. You agree that the zakdental.com online platform may process payment for all Membership Fees associated with the Dental Membership Plan that you choose using the payment method (e.g., credit card, debit card, etc.) that you have provided in your Account Information. It is your responsibility to notify your Dentist if your payment method has changed. If you do not provide a valid payment method, or if your designated payment method is determined to be inactive for any reason, your Dentist may immediately discontinue your enrollment in the Dental Membership Plan. You agree not to cause your credit or debit card company to reverse or chargeback any fees charged in accordance with this Agreement; and in the event you do so, we and/or your Dentist may terminate your enrollment in the Dental Membership Plan, and you agree to reimburse us and/or your Dentist for any costs incurred in responding to such chargeback, including, without limitation, our and your Dentists actual costs paid to the credit or debit card company, including chargeback fees, and the value of the time our and your Dentists employees spend on the matter as determined in our or your Dentists discretion in good faith. Your Dentist may increase the Membership Fee of the Dental Membership Plan from time to time. You will receive an email notification to the email address you registered on the zakdental.com online platform of any such increase in fees no less than thirty (30) days before the new rate becomes effective. If you do not agree to the increase(s), you may cancel your membership. By establishing an Account and enrolling in a Dental Membership Plan through the zakdental.com online platform, you authorize the Dentist in whose Dental Membership Plan you are enrolling to bill for the monthly Membership Fee or annual Membership Fee. If your payment method on file or billing information changes, it is your responsibility to provide updated information to us on a timely basis. Your zakdental.com online platform / Member Account dashboard will include real-time data with respect to your enrollment information, including the beginning of the current enrollment period and a history of your payments of Membership Fees.

    4. LIMITATIONS. Not all dental services are Included Services under the Dental Membership Plan. Only those specifically listed by your Dentist as Included Services are provided by your Dentist at no additional charge to you. If you require any dental services that are not Included Services, you are responsible for paying your Dentist for those Non-Included Services at the rates established by your Dentist. You may also be subject to a Dentists late payment fee and other applicable office policies. Any disputes over the fees charged by dentists must be addressed directly with the Dentist. Use of the zakdental.com online platform requires compatible devices, internet access, a unique email address, and certain software; and may be affected by the performance of these factors. You agree that meeting these requirements, which may change from time to time, is your responsibility. We do not represent or guarantee you will be able to access the zakdental.com online platform at all times.

  • Member Cancellation during the initial ninety (90) day period. * If you cancel your membership in the Dental Membership Plan during the initial ninety (90) days* following your enrollment (whether such payment is a monthly payment or an annual payment) your Dentist will provide a full refund of your paid Membership Fees. NOTWITHSTANDING THE FOREGOING, IF YOU HAVE RECEIVED ANY DENTAL SERVICES UNDER YOUR DENTAL MEMBERSHIP PLAN WITHIN THE FIRST NINETY (90) DAYS* AND CANCEL YOUR MEMBERSHIP IN THE DENTAL MEMBERSHIP PLAN AFTER RECEIVING THOSE SERVICES, YOUR DENTIST WILL BILL YOU FOR THE SERVICES RENDERED TO YOU AT YOUR DENTISTS THEN-CURRENT, NONDISCOUNTED UCR (USUAL AND CUSTOMARY RATES). PAYMENT IN FULL FOR ANY SERVICES RENDERED BY YOUR DENTIST DURING THIS PERIOD WILL BE REQUIRED PRIOR TO CANCELLATION OF YOUR MEMBERSHIP IN THE DENTAL MEMBERSHIP PLAN, AND THE ISSUANCE OF A REFUND.
  • Billing Error. In order to be considered a billing error you must provide sufficient written documentation to demonstrate the existence of a billing error and adequate proof of the amount paid due to such error.
  • Dental Membership Plan Termination. If your Dentist terminates your membership in a Dental Membership Plan without your consent or permission, or ceases offering a Dental Membership Plan, your Dentist will provide a pro rata refund to the payer on your Account.
  • 7. COMPLAINTS. All complaints about the dental services provided by the Dentist, the fees you were charged, or any other dissatisfaction with a Dentist, must be addressed directly with the Dentist. You may submit your complaint via our online help request system or by contacting our team via email.

    8. GOVERNING LAW; ARBITRATION. The Agreement shall be governed by and construed in accordance with the laws of the State of California, without reference to conflicts of those laws provisions and, as to matters affecting copyrights, trademarks and patents, by U.S. federal law. Any dispute or claim arising out of, or in connection with, this Agreement shall be finally settled by binding arbitration in Los Angeles, California, in accordance with N.C. Gen. Stat. 1-569.1 et seq. (the Uniform Arbitration Act) and the then-current rules and procedures of the American Arbitration Association by one (1) arbitrator appointed by the American Arbitration Association. The arbitrator shall apply the law of the State of California, without reference to rules of conflict of law or statutory rules of arbitration, to the merits of any dispute or claim. Judgment on the award rendered by the arbitrator may be confirmed, reduced to judgment and entered in any court of competent jurisdiction. You agree that, any provision of applicable law notwithstanding, the arbitrator shall have the authority to award the prevailing party its costs and reasonable attorneys fees. In the event that the above arbitration provision is held invalid or unenforceable, then any dispute with respect to the Agreement shall be brought and heard either in the California state courts located in Los Angeles, California, or the federal district court located in Los Angeles, California. In such event, you consent to the in personam jurisdiction and venue of such courts. You agree that service of process upon you in any such action may be made if delivered in person, by courier service, by first class mail, and shall be deemed effectively given upon receipt.

    9. CHANGES TO THESE TERMS AND CONDITIONS. Dr. Zak Dental Care reserves the sole right at any time to modify, discontinue, or delete portions of these Terms. We will notify you of any material changes to these Terms by email to the email address that you have registered on the zakdental.com online platform. It is your responsibility to check your email periodically for changes to the Terms. If you do not agree with the new Terms, you must cancel your membership and stop using the zakdental.com online platform Services. Your continued use of the zakdental.com online platform, the zakdental.com online platform Services and/or the Dental Membership Plan after any changes to these Terms constitutes your acceptance of the revised Terms and Conditions.

    Terrible experience here. Wasted 3 appointments before actually getting a cleaning scheduled. Was then done in 15 minutes with no flossing or removing plaque. Save your time and find somewhere else.

    Such a horrible experience here. I had to go to them because of my insurance and nowhere else was available. The dentist and assistant didn't know what kind of work they were doing on me, I had to stop and make sure it was the right treatment. The dentist was extremely rude and didn't tell me what he was putting in my mouth or what he was doing. At one point when he was waiting for the numbing medicine to set in, he was just shaking his head. How reassuring that feels. They were supposed to work on several teeth for me, but after one larger filling they said they were done for the day and didn't work on the rest of my teeth that needed work. I was extremely uncomfortable and honestly scared. If you can avoid it, do not go here for dental work.

    TRUST THE REVIEWS. ORTHO IS A HORRIBLE, UNETHICAL, NEGLIGENT, HUMAN BEING who doesnt care about your health nor respect your time. As a college student, I came for Invisalign and was given a "college student price" of $3500. For months ahead of time I let the ortho know I would be moving away cross-country and would need to have my retainers ready for my last visit (March). She informed me not to worry she would take care of everything. That was the complete opposite of what she did. She did NOT inform me that I needed my impressions taken so when I flew out I had them taken in March. Okay fine, I asked about a new spare final set since the set I have been wearing has worn out and is causing my teeth to shift. She told me I would have to pay $600 for my last set and wait 2 Weeks or just wait 3 weeks for my retainers. NO brainer imma wait 3 weeks... I flew out again (June) only to be informed that Invisalign rejected the impressions their staff took... NOT ONE CALL OR MESSAGE TELLING ME THEY REJECTED!!!! So now im freaking out, questioning their system and how they could lack the benevolence to inform me of any changes!!! The next parts my fav. THE LADY WHO TOOK MY IMPRESSIONS COMES OUT WITH SET 12 of 12 and GIVES THEM TO ME FOR FREE. HOW DARE THIS COMPANY TRY AND CHARGE ME $600 & wait 2 weeks FOR SOMETHING THEY HAD IN THEIR POSSESSION!!!!!! Dr. Zak has recently changed their front assisting staff so my theres no issues with them, just the greedy high end payed professionals who will face their karma in generations to come :)

    I have been trying to get in touch with Zak Dental for four months now, regarding my partner's burns from the bleach treatment he received, and a negative overall experience with a filling. I have not heard back from the billing department in spite of countless messages and phone calls and physical forms that I have filled out. I am super upset with this experience overall. Update: I gave Zak Dental a call like they told me to in response to this review, and they followed the same steps as they always do, which is to wait for the Billing Department to call me, in spite of waiting since January. The phonecall did nothing to help.

    Botched appointments, unfriendly service, technicians that dont know what they are doing pieced together technology/equipment. Good luck getting any money back from them! This is a conglamoration of offices with horrible coordination/support. Stay away! Look on yelp, youll see many more horror stories.

    I do not recommend this business and suggest avoiding them at any cost. Unfortunately I got new insurance and these were the only people I could see. I went to them in January for one of their Wellness32 visits or whatever they call it. The XRay machine didn't work, for starters, and the people did not know how to operate it either. After the visit they assigned me a Wellness Coordinator, which is basically just a sales person, who reviewed my treatment options with a dentist over the phone, then scheduled me to begin work on an overall plan that came to almost $15,000. She asked how I would be paying, and I have a CareCredit account so I gave her that info, at which time she pre-charged me $4500! No services had even been performed!! It has been over three months and so far all they have done is $2000 worth of work, yet I am paying, and my credit score is reflecting, a $4500 charge. Repeated email requests for a statement of account and a refund have gone unanswered, not to mention the very first visit I went to they pulled a tooth they originally told me they could fix! This company is painfully unprofessional. Responding to your reply on 4/10, this has nothing to do with the timeframe of the treatment, do not try and turn it around. You gave me a treatment plan in January that, after the very first visit you could not actually execute because your Wellness 32 consult wasn't thorough and the dentist misdiagnosed two major parts of the treatment. Next, I have no less than two or three emails to my treatment coordinator, Gina, that went unanswered, my assumption is because I kept asking for an adjustment on the $4500 PRE-TREATMENT charge you put on my credit card. Not until I left a bad review, filed a complaint with Aetna, and threatened to file a complaint with the CA Dental Board did I finally get a call from someone and an email with a statement of account and a refund. And no, I'm not entirely thrilled with the fact that you were unable to fix my teeth the way your Wellness32 dentist said you could, and that $1500 later all I have is two pulled teeth and replacement crown. Cheers!

    I originally gave them a 5 star because they were nice at first, even though one of there associates bombarted me with there " free gift " and how "was everything " the associate even asked me to see my phone and went on yelp and google to in put a 5 star and for me to write my comments. Which at the time we're how I felt. Not knowing all the drama that was to come. I'm at the point of making a complaint at the better business bureau. They maxed my credit card for all my treatment needed, without being done. The second treatment they told me they couldn't do because it needed a different treatment. Then they were trying to schedule appointments without the other issues being done. When they were trying to fix the mis diagnosis they didn't even follow up I had to keep bugging. Mind you they had already charged my card$3,800 and my insurance the other $7,000. Then they over charged my daughter about $100, because the treatment dentist said she didn't need what they originally ordered done. Has been getting the run around with no resolution to her getting her $. I'm reaching out to the only associate to has tried to help me with this issue. Just ridiculous.

    My son had the most unprofessional and worst dental experience. They had the wrong treatment plan when they began the work and they had to be reminded what treatment he was there for. During the whitening procedure they put him in a back room and forgot about him. He had to go look for someone after he took the trays out himself. One star is too high

    I scheduled my appointment over a month ago. I received a email confirmation last nite about my first time appointment. I took time off work, and showed up 30 minutes early. The doors were locked and a sign stating they were closed today (Wednesday) wen I called the operator seemed to be in a different city and said they were closed?!?!?!? Not only was I not notified but i was actually confirmed about this appointment. I just hope they don't try and bill my insurance now. SMH

    I showed up on my appointment day and time, and was accommodated with high regard to quality of service and I like the home-y feel. I mean they are all very professional in performance, not mediocre type of dental care, but high level, and yet they can manage to be warm and kind (to me, in particular). As a result, I'm happy with my dental work at Zak Dental Sta. Barbara. Sure worth recommending to friends in SB area !

    Found everyone in Zak Dental Santa Barbara very caring and involved. I forgot my anxieties. because I was welcomed and well cared. Got root canal treatment1, I am also free from cavities and now have a calmed spirit coz my trust to dentist was revived!

    Drove my mom to this place a week ago and she had a wonderful time with her dentist. The dentures they make for mom fitted well, she has no jaw pains at all. The front staff and the rest of the people inside the office treated her with respect. I like these guys.

    As a regular here at Santa Barbara Dental Care, my experience is always stellar! Same level of service which is above expectations no matter what dental issue drove me here. My most recent visit was getting a small cavity filled after a cleaning. Both my dentist and my hygienist were gentle and thorough with their work. I left the office with the same old feeling of contentment.

    I must admit, my first visit at Zak Dental Care was an absolute delight! The front officer was extremely personable and my hygienist was so lovely to connect with and my dentist was insightful and fun. I've had so many unfortunate experiences in the past, being judged by other practices, but in Zak DC Santa Barbara location, it was total opposite, very dignified and compassionate. So glad I've come across this office!
