UT Physicians respects your rights as a patient and recognizes you are an individual with unique health care needs. We want you to know what your rights are as a patient and what your obligations are to yourself, to your health care providers, and to UT Physicians.

We encourage a partnership between you and your health care team. Your role as a member of this team is to exercise your rights and take responsibility by asking for clarification of things you do not understand.

If you have a complaint or feel your rights are not being respected, please immediately inform the staff or contact the patient experience office at 713-486-1875 or complete our contact us form. The Patient Experience team will coordinate a prompt resolution. The presentation of a complaint or grievance will in no way compromise your care. Patients expect the information they give to their health care providers will remain confidential and protected. Patients want to know what information is kept, who has access to their information, how records can be amended and errors corrected, and what rights patients have concerning their health information.

In recognition of patients rights and the increasingly complex flow of health information, Congress passed a federal law in 1996 that, among other things, required the Department of Health and Human Services (DHHS) to issue Privacy Standards. This law is called the Health Insurance Portability and Accountability Act of 1996, and it is commonly referred to as HIPAA.

DHHS, in turn, wrote the Standards for the Privacy of Individually Identifiable Health Information. Entities covered by the Privacy Standards, including health care providers, health care clearinghouses, and health plans, were required to comply with these standards by April 14, 2003. UT Physicians is a health care provider and, therefore, is covered by HIPAA.

UT Physicians protects the privacy of patients Protected Health Information in compliance with applicable provisions of the Health Insurance Portability and Accountability Act of 1996, Public Law 104-191 (HIPAA), and regulations promulgated hereunder by the U.S. Department of Health and Human Services (Privacy Rule) and all other applicable privacy-related state laws, regulations and other jurisprudence which are not preempted by HIPAA.

The Privacy Standards cover Protected Health Information (PHI). PHI is individually identifiable health information related to the past, present or future physical or mental health condition of a person. The definition of PHI excludes individually identifiable health information in education records covered by the Family Educational Rights and Privacy Act (20 USC 1232g).

PHI under HIPAA means individually identifiable health information. This definition is narrowed to information created or received by a health care provider, health plan, employer, or health care clearinghouse. Oral, written, or electronic forms of information are protected. Information relating to the provision and the payment for the provision of health care is also included in this definition.

Treatment: The Privacy Standards permit a health care provider to disclose protected health information about a patient, without the patients authorization, to another health care provider for that providers treatment of the patient.

Payment: Payment encompasses the various activities of health care providers to obtain payment or are reimbursed for their services and a health plan to obtain premiums, fulfill their coverage responsibilities, provide benefits under the plan, and obtain or provide reimbursement for the provision of health care.

Health Care Operations: DHHS defines Health Care Operations as certain administrative, financial, legal, and quality improvement activities of a covered entity that are necessary to run its business and support the core functions of treatment and payment.

As full-time faculty at McGovern Medical School, our physicians serve as role models to medical residents and students, in addition to being involved in teaching and research activities. Resident physicians are doctors who have completed medical school and are continuing their three- to four-year specialty training. All of our residents are personally supervised by a faculty physician who reviews each case. Medical students also work in the clinic. If a medical student is seeing you, you will also be seen by a faculty physician. If a resident is seeing you, a faculty physician is always available and familiar with your case. By involving both the residents and medical students in patient care, you can be assured that your health needs are thoroughly reviewed and are used to teach the next generation of physicians.

Established in 1972 by The University of Texas System Board of Regents, The University of Texas Health Science Center at Houston (UTHealth Houston) is Houstons Health University and Texas resource for health care education, innovation, scientific discovery and excellence in patient care. The most comprehensive academic health center in the UT System and the U.S. Gulf Coast region, UTHealth Houston is also home to schools of biomedical informatics, biomedical sciences, dentistry, nursing and public health. UTHealth Houston includes The University of Texas Harris County Psychiatric Center.

Memorial Hermann-Texas Medical Center, a partner in the Memorial Hermann Healthcare System, is the primary teaching hospital of McGovern Medical School in the Texas Medical Center (TMC). The hospital serves as the center of inpatient clinical activity for McGovern Medical Schools full-time faculty who work closely with part-time faculty and volunteer physicians.

The Lyndon B. Johnson (LBJ) General Hospital, owned and operated by the Harris County Hospital District, is the second primary teaching facility for McGovern Medical School. Health-care services for the hospital district are provided by Affiliated Medical Services, a nonprofit organization composed of McGovern Medical School and Baylor College of Medicine faculty, which staff LBJ and Ben Taub General Hospital, respectively.

MD Anderson Cancer Center Created in 1941 as a component of The University of Texas System and one of the nations three comprehensive cancer centers, The University of Texas MD Anderson Cancer Center was ranked as the top hospital in the nation for cancer care by U.S. News & World Report. McGovern Medical Schools Department of Dermatology is a joint department with MD Anderson Cancer Center, and our physicians, residents, students, and faculty work closely in the pursuit of education, research, and improving patient care.

TIRR Memorial Hermann Recognized for 20 years as one of Americas Best Rehabilitation Hospitals, TIRR was ranked #3 in 2014 by U.S. News & World Report. TIRR treats patients with a range of disabilities from complex conditions like brain injury, stroke, spinal cord injury, multiple trauma and amputation, to rehabilitation to conditions including multiple sclerosis, Parkinsons disease, post-polio syndrome, rheumatoid arthritis and lupus. McGovern Medical Schools Department of Physical Medicine and Rehabilitation is closely aligned with TIRR.
